IRDAI Allows Policyholders to Cancel Policies and Get Refunds

The Insurance Regulatory and Development Authority of India (IRDAI) has introduced a policyholder-friendly measure, enabling individuals to cancel their insurance policies and receive refunds. This initiative aims to enhance the flexibility and satisfaction of policyholders in managing their insurance needs.

Cancellation Guidelines

The new guidelines provide clear instructions on how and when policyholders and insurers can cancel policies, ensuring transparency and fairness in the process.

img Cancellation by Policyholder 

 Voluntary Cancellation

   – Retail policyholders have the right to cancel their insurance policies at any time during the policy term.

   – Policyholders are not required to provide reasons for cancellation.

   – The policyholder must inform the insurer of their decision to cancel the policy.

img Cancellation by Insurers

1. Grounds for Cancellation

   – Insurers can cancel a policy only on the grounds of established fraud.

   – A minimum notice period of 7 days must be provided to the retail policyholder before the cancellation takes effect.

2. Restrictions on Cancellation

   – Insurers are prohibited from canceling statutory Motor Third Party Liability insurance or any other compulsory insurance mandated by law.

   – Exceptions are allowed only in cases of double insurance or total loss.

img Refund Procedures

Upon cancellation of a policy, the insurer is required to refund the premium for the unexpired policy period, subject to certain conditions:

1. Policies with a Term of Up to One Year
– If no claims have been made during the policy period, the insurer will refund a proportionate premium for the remaining term of the policy.

2.Policies with a Term of More Than One Year
– If the risk coverage for future policy years has not commenced, the insurer will refund the premium for the unexpired policy period.
